The Environmental Clearance Certificate (ECC) is required to support the proposed subdivision of Erf 738, Walvis Bay, and the creation of a private right-of-way servitude. Although these activities are not listed under the Environmental Management Act, 2007 (Act No. 7 of 2007) and the Environmental Impact Assessment Regulations (2012), the ECC application serves to formally register the project with the Ministry of Environment, Forestry and Tourism (MEFT) and to enable the Competent Authority to screen the development. This screening process determines whether a full Environmental Impact Assessment (EIA) is necessary. In addition, the ECC process ensures that relevant project information is documented, Interested and Affected Parties (I&APs) are informed and given an opportunity to provide input, and that the proposed development is reviewed in line with environmental requirements before any approval is granted.
